Client Coaching Agreement & Terms and Conditions

Health • Energy • Results

These Terms and Conditions set out the agreement between HER (“HER”, “we”, “us” or “the Coach”) and you (“the Client”) when you purchase or participate in any HER coaching service.

Please read these Terms and Conditions carefully before beginning your programme.

By purchasing a HER service and/or confirming your acceptance of these Terms, you agree to the conditions set out below.

1. About HER

HER provides personalised nutrition, lifestyle, fitness and personal training support designed to help women become stronger, healthier and more confident.

Our approach is centred around sustainable nutrition and lifestyle habits, supported by appropriate exercise, strength training and ongoing coaching.

Depending on the HER service you choose, your coaching may include:

  • Personalised nutrition and lifestyle guidance

  • Individual calorie and macronutrient targets where appropriate

  • Exercise and personal training programmes

  • In-person personal training

  • Online training support

  • Regular progress reviews and check-ins

  • Goal setting and accountability

  • Educational resources

  • WhatsApp or online coaching support

  • Progress measurements and photographs

  • Group coaching and/or training

The exact services provided will depend upon the HER programme or package you have purchased.

2. HER Coaching Services

HER currently offers a range of coaching options, which may include:

Essential HER

A one-off nutrition and lifestyle consultation designed to provide personalised guidance, targets and an achievable action plan.

Transform HER

A structured six-week coaching programme combining personalised nutrition coaching, lifestyle guidance, exercise programming, accountability and regular progress reviews.

HER Together

A structured six-week group coaching programme combining nutrition, lifestyle and exercise support with group training and accountability.

HER Progress

Ongoing nutrition and online fitness coaching designed to provide continued support, accountability and progression.

HER Progress is subject to an initial minimum three-month commitment and then continues on a rolling monthly basis unless cancelled in accordance with these Terms.

With HER

Personalised ongoing nutrition and fitness coaching including regular one-to-one, in-person personal training.

The exact content, price, duration and inclusions of your chosen service will be confirmed before you purchase or begin your coaching.

3. Client Health and Suitability

Your health and safety are important.

Before beginning coaching, you must provide HER with accurate and complete information regarding your:

  • Current health

  • Relevant medical conditions

  • Injuries

  • Medication where relevant to safe participation

  • Pregnancy or postnatal status where applicable

  • Previous or current eating disorders or disordered eating where relevant

  • Exercise experience

  • Any other information that could reasonably affect your ability to participate safely

You are responsible for informing HER if any of this information changes during your coaching.

HER may recommend that you seek advice or clearance from your GP or another appropriately qualified healthcare professional before beginning or continuing exercise or nutrition coaching where we believe this is appropriate.

HER reserves the right to pause, modify or decline coaching where we reasonably believe that the Client's needs fall outside our professional scope of practice or that participation may not be appropriate without further professional or medical input.

4. Nutrition Coaching

HER provides nutrition coaching, education and practical lifestyle guidance within the Coach's professional qualifications and scope of practice.

Nutrition coaching may include guidance relating to:

  • Energy and calorie intake

  • Macronutrients

  • Meal structure

  • Food choices

  • Hydration

  • Eating habits

  • Sports and exercise nutrition

  • Recovery

  • Sustainable weight management

  • Supporting body-composition and performance goals

HER does not diagnose, treat or prescribe for medical conditions and nutrition coaching is not intended to replace advice or treatment from a GP, registered dietitian or other appropriately qualified healthcare professional.

Where a Client's nutritional or medical needs fall outside HER's professional scope, we may recommend referral to an appropriate healthcare professional.

5. Exercise and Personal Training

Where exercise programming or personal training forms part of your HER service, programmes will be designed based on the information available to us regarding your goals, experience, ability and health.

You agree to:

  • Follow exercise instructions carefully

  • Use appropriate equipment and technique

  • Exercise within your individual capabilities

  • Inform your Coach about injuries, pain or changes in your health

  • Stop exercising if you experience unusual pain, dizziness, faintness, chest pain, severe shortness of breath or other concerning symptoms

Where you complete training without your Coach physically present, you are responsible for ensuring that the environment and equipment you use are appropriate and safe.

You should seek appropriate medical advice where symptoms or injuries require investigation.

6. Client Responsibilities

Coaching works best as a partnership.

By participating in HER coaching, you agree to:

Be honest.
Provide accurate information about your health, lifestyle, nutrition, exercise and progress.

Communicate.
Keep your Coach informed of relevant changes, concerns, difficulties or injuries.

Participate.
Engage with the agreed coaching process, check-ins and reviews where these form part of your programme.

Take responsibility.
HER provides professional guidance, education, support and accountability, but you remain responsible for the decisions and actions you take outside coached sessions.

Ask questions.
If you are unsure about any recommendation, exercise or aspect of your programme, please ask before proceeding.

7. Results and Progress

HER is committed to providing professional, personalised coaching and supporting you towards your goals.

However, individual results cannot be guaranteed.

Results including weight loss, fat loss, muscle gain, improved strength, fitness, health markers or changes in body composition vary between individuals.

Progress may be affected by factors including:

  • Programme adherence

  • Nutrition

  • Exercise

  • Sleep

  • Stress

  • Health

  • Medication

  • Hormonal changes

  • Lifestyle

  • Genetics

  • Previous dieting or training history

Your programme will be reviewed and adjusted where appropriate, but HER does not guarantee any specific outcome within a particular timeframe.

8. Fees and Payment

The price and payment structure for your chosen HER service will be clearly communicated before you purchase.

Unless otherwise agreed, payment must be made by the stated payment date and in accordance with the payment schedule for your chosen service.

One-off programmes may require payment in full before coaching begins.

Monthly coaching services will be charged according to the agreed recurring payment schedule.

Failure to make an agreed payment may result in coaching being paused or terminated until payment is brought up to date.

9. Your Right to Cancel

Where you purchase a HER service online, by telephone or otherwise at a distance, you may have a legal right to cancel your contract within 14 days of entering into the agreement.

If you request that HER begins providing your coaching during this 14-day cancellation period, you expressly request that the service begins before the cancellation period has expired.

If you subsequently exercise a statutory right to cancel after coaching has begun, you may be required to pay for the proportion of services already provided, where permitted by law.

Where a service has been fully performed during the cancellation period following your express request and acknowledgement, your statutory cancellation right may be affected in accordance with applicable consumer law.

Nothing in these Terms affects your statutory consumer rights.

10. Programme Commitments and Cancellation

Fixed-Term Programmes

Services such as Transform HER and HER Together are sold as fixed-term programmes.

Once any applicable statutory cancellation period has expired and the programme has commenced, you are committing to the full programme.

If you choose to stop participating before the end of the programme, refunds will not normally be provided for services already delivered or costs reasonably incurred.

Any entitlement to a refund for services not yet provided will be considered in accordance with your statutory rights and the circumstances of the cancellation.

HER Progress

HER Progress has an initial minimum commitment of three months.

After the initial three-month period, HER Progress continues on a rolling monthly basis unless cancelled.

You may cancel the rolling service by notifying HER in writing before your next scheduled monthly payment.

Cancellation will take effect at the end of the period you have already paid for.

With HER

The payment and minimum commitment, if applicable, for With HER will be confirmed before coaching begins.

Where the service operates on a rolling monthly basis following any agreed minimum term, you may cancel by notifying HER in writing before your next scheduled payment.

11. In-Person Personal Training Sessions

Where your HER service includes booked one-to-one personal training sessions, at least 24 hours' notice should be provided if you need to cancel or rearrange a session.

Sessions cancelled with less than 24 hours' notice will normally be treated as used and charged in full.

HER understands that genuine emergencies and exceptional circumstances happen and these may be considered at the Coach's discretion.

If HER needs to cancel a session, the session will be rearranged at no additional cost or credited back to the Client.

If you arrive late for a session, the session will normally still finish at the originally scheduled time.

12. Illness, Injury and Programme Pauses

If illness, injury or another significant circumstance prevents you from participating in your programme, please contact HER as soon as possible.

Where appropriate and reasonably possible, HER may agree to modify, pause or extend a programme.

Any pause or extension will be considered individually and is not automatically guaranteed.

HER may request appropriate medical clearance before exercise coaching resumes following significant illness, injury or another relevant health event.

13. Communication and Coaching Support

The level and method of communication available will depend on your chosen HER service.

Where WhatsApp, messaging or online check-ins are included, these services are intended for coaching support and are not monitored as an emergency service.

HER will aim to respond within a reasonable timeframe during normal working periods.

Clients should contact an appropriate healthcare professional or emergency service where urgent medical assistance is required.

14. Risk and Liability

Physical exercise carries an inherent risk of injury.

By participating in exercise, you acknowledge and accept the ordinary risks associated with physical activity.

You are responsible for exercising within your capabilities, following the guidance provided and informing HER of relevant health conditions, symptoms, injuries or changes in your circumstances.

HER will take reasonable care in providing its services.

Nothing in these Terms excludes or limits HER's liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence.

HER is not responsible for losses or injuries caused by a Client failing to disclose relevant information, failing to follow reasonable instructions or undertaking activities outside the advice or programme provided, except where HER is legally responsible.

15. Confidentiality and Privacy

HER respects your privacy and will treat personal information shared during coaching confidentially.

Information may include:

  • Contact details

  • Health information

  • Medical and injury information

  • Lifestyle information

  • Nutrition information

  • Exercise information

  • Weight and body measurements

  • Progress information

  • Photographs

Some of the information provided to HER may constitute health data and therefore receive additional protection under applicable data protection legislation.

HER will collect, store and use personal information only where there is an appropriate lawful basis and in accordance with applicable UK data protection requirements.

16. Progress Photographs and Testimonials

Progress photographs taken or supplied as part of coaching will be treated as confidential coaching information.

HER will not use identifiable progress photographs, testimonials or personal stories for marketing or social media purposes without appropriate permission.

Marketing consent will be requested separately from these Terms and Conditions.

Choosing not to provide marketing consent will not affect your ability to participate in HER coaching.

17. Intellectual Property

Training programmes, nutrition resources, recipes, educational materials, coaching documents, worksheets and other materials supplied by HER remain the intellectual property of HER unless otherwise stated.

They are supplied for your personal use.

You must not reproduce, sell, publish, distribute or share HER materials commercially or with third parties without prior written permission.

18. Ending the Coaching Relationship

HER aims to maintain a positive, respectful and professional coaching environment.

HER reserves the right to end the coaching relationship where there is a reasonable basis to do so, including:

  • Repeated non-payment

  • Abusive, threatening or inappropriate behaviour

  • Serious or repeated breaches of these Terms

  • Concerns that continuing coaching is unsafe

  • The Client's needs moving outside HER's professional scope of practice

Where HER ends a service, any payment relating to services not yet provided will be dealt with fairly and in accordance with applicable consumer law.

19. Complaints

If you are unhappy with any aspect of your HER service, please contact HER directly in the first instance.

We want clients to feel comfortable raising concerns and will make reasonable efforts to resolve complaints fairly and promptly.

Making a complaint does not affect your statutory rights.

20. Changes to Services or Terms

HER may occasionally need to make reasonable changes to its services or these Terms and Conditions.

Where a change materially affects an existing Client's service, HER will provide reasonable notice where practicable.

Any changes will not affect statutory rights or unfairly remove rights that have already arisen under an existing agreement.

21. Governing Law

These Terms and Conditions are governed by the laws of England and Wales.

Nothing in these Terms affects any mandatory rights you may have as a consumer, including rights relating to where legal proceedings may be brought.

What to include in the Refund Policy

Generally speaking, a Refund Policy often addresses these types of issues: the timeframe for asking for a refund; will the refund be full or partial; under which conditions will the customer receive a refund; and much, much more.
